This is an absolute and open-ended duty on the employer, and one that many of them resist. 51 recommends that Branches and LAs negotiate an agreement on time off for safety representatives which does not undermine the statutory standard, and includes the following 10 points.  1 A clause recognising the employers duties to permit such time-off as shall be necessary. 2 A clause recognising that trade union safety representatives play a valuable and constructive role in the institution, and that, in order to play that role, safety representatives must be well-trained and aim to be as knowledgeable as their management counterparts. 3 Set out that basic 51 safety rep training comprises a number of parts: a short induction on appointment, the TUC Stage 1 and Stage 2 safety reps courses each of 10 days duration, and the TUC Certificate in Occupational Safety & Health of 36 days duration. 4 Beyond the basic training, 51 representatives training will also include a programme of short one or two-day courses on specific health & safety issues. 5 An employer commitment to pay any travel costs and other out-of-pocket expenses incurred by the representative attending a course. 6 An employer commitment to provide any resources the rep needs arising out of the course they attend, in line with SRSCR Reg 4A(2). 7 In consultation with the Branch/LA an employer committed to establish a cross institution budget based on an estimate of the annual overall cost of safety reps training and make provision for sufficient budget allocation to ensure that cost does not become a reason for refusing or delaying time-off for training. Health and safety training costs should be a central cost and not fall on individual departments. 8 To ensure the employer makes adequate arrangements to cover all the work the rep would normally have done during their attendance on a training course. 9 In particular, the employer should, in respect of staff who teach seek to make every effort to set the time-off against timetabled teaching hours wherever possible. The minimum acceptable standard is that the employer must ensure that time-off is at l east proportionate to the teaching and other duties the rep normally works.
