Colleges were given until noon 11 September to confirm that they would meet our claim. Branches which have submitted the national pay claim locally with additional claim elements can also participate with coordinated ballots and action. These branches were asked to hold branch meetings before 11 September to consider the progress of the negotiations with their particular employer and decide whether to join coordinated ballots and action. Those colleges who have not confirmed that they will meet 51s national claim and those where the 51 branch are not satisfied with the progress of negotiations on their national plus claim will today receive notice of 51s intention to conduct an industrial action ballot of its members. The ballot will open on 28 September and will close at 12 noon on 15 October. All branches which are being balloted should now have received campaign materials including posters, flyers and stickers urging members to vote in favour of taking strike action. Post 16 education and training area based reviews At the end of July the government announced a post-16 education and training area based review process. Detail and guidance at that time was limited, but at the beginning of September further information was published. Reviews will cover post-16 education and training provision, including sixth form colleges and independent providers. School sixth forms are not included but the document says We want to encourage school sixth forms to collaborate to a greater extent to help drive efficiencies. The Minister explicitly states We need to move toward fewer, larger, more resilient and efficient colleges. They also want to introduce new Institutes of Technology (potentially one in each LEP area) and are keen on specialisation and greater use of technology. The reviews will be led by steering groups consisting of college chairs of governors, EFA and SFA, LEPs, local authorities, regional schools commissioners, SFC and FE Commissioners. Steering groups will have responsibility for ensuring the outcome is coherent with alignment between institutions and the progression routes of young people. In response to the initial announcement about area reviews 51 immediately pointed out that staff involvement as key stakeholders was missing from the potential steering group membership. We are disappointed to see that in the more recent fuller guidance this oversight has not been addressed and staff are not mentioned in the document at all except a brief reference at the implementation plan stage. Staff of course should be involved much earlier than when the plan is ready for implementation. Each review will start with an assessment of the economic and educational needs of the area (produced by LEPs and local authorities), looking forward to the economic priorities currently and of the next 5-10 years, current and future demand for education at 16 plus, progression routes and the level at which what publicly funded provision is affordable. Current provision will be assessed, including individual institutions in scope for quality, curriculum, finances and estate. The steering group will produce an options analysis on the basis of these assessment. The document is clear that where mergers are considered these are not the objective, but the process. However it is also reiterated that the expectation is for fewer institutions. It will be for governing bodies to decide whether to accept the recommendations. They are therefore expected to be proactively involved in the review process, ensuring that their preferred options are covered by the analysis. But there are strong funding levers at the governments disposal, with it being stated that Ultimately we expect the funding agencies, LEPs and national partners only to fund or support institutions that have taken action to ensure they can provide a good quality offer to learners and employers, which is financially sustainable for the long term. If the governments view does not match that of the governing body it seems clear that by controlling funding government will have the final say. The first area review starting 18 September will focus on Birmingham and Solihull, followed by Greater Manchester, 21 September and Sheffield City Region, 28 September. The entire process is due to be completed by March 2017 and include 40 reviews. Individual reviews are expected to be 3-4 months long. The document says that colleges, LEPs and local authorities will be expected to provide funding to support any changes arising from the review. 51 has written to the FE Commissioner and BIS officials seeking to be included both in the national steering group and 51 regional officials have written to the chairs of their relevant local area reviews as they are announced seeking a position on those steering groups. Regional officials will contact branch officers in colleges affected by local area reviews to help coordinate our approach and to ensure that affected branches speak with one voice. So far the following reviews have been announced: Birmingham and Solihull Birmingham Metropolitan College Bournville College Solihull College South and City College Birmingham Greater Manchester Bolton College Bury College Hopwood Hall College Salford City College Stockport College Tameside College The Manchester College The Oldham College Trafford College Wigan and Leigh College Sheffield City Region Barnsley College Chesterfield College Dearne Valley College Doncaster College North Nottinghamshire College Rotherham College Northern College Sheffield College New model organisational change agreement and revised national agreement on redundancies Many FE colleges are in the middle of another round of knee-jerk redundancy, contract change and re-structure exercises that have blighted the sector for years and are being made worse by the scale of funding cuts. These re-organisations are often ill thought through and costly exercises conducted under unnecessarily short time frames. A far more long-term and considered approach to change is required at a local level. An approach that is inclusive, not rushed and is given the time required to consider all options before decisions are made. 51 approached the Association of Colleges to negotiate a new national guidance agreement on the handling of organisational change in further education to assist and support colleges dealing with significant change. Unfortunately the AoC said that it did not have a mandate to negotiate such an agreement. Therefore, in order to assist branches that want to establish an enhanced agreement with their college on all aspects of organisational change and redundancies 51 has produced a model agreement for branches to use when negotiating improved procedures. Procedures to ensure genuine and meaningful dialogue and consultation on all re-structure proposals to allow for alternatives to be considered before final decisions are made. Comprehensive procedures for minimising and mitigating negative impacts on staff during reorganisations including provision of salary protections and voluntary severance packages. Orderly, objective and transparent procedures for dealing with staffing changes including slotting in, bumping, retraining and redeployment. Enhancement to statutory redundancy consultation periods. With these procedures in place better, more strategic and long-term decisions can be made which will avoid the annual round of uncertainty and provide more security to those working in colleges and better outcomes for the organisations as a whole. There is also a revised version of the national agreement, however this is more limited in scope and mostly reflects statutory entitlements to consultation. This agreement was revised and renegotiated following changes to legislation which reduced the minimum redundancy consultation periods required. The revised agreement reflects these statutory changes. However Clause 2 of the agreement recommends early consultation and dialogue with recognised trade unions as a means to avoiding the need for redundancies. This might include consideration of the Colleges performance, funding and future plans to identify any economic, technical or organisational issues affecting the need for changes in the size of the workforce. Branches will now find it difficult to mobilise to fight against job cuts in the reduced consultation periods therefore it would be useful to have earlier warning that a change in size or structure of the workforce is likely. However the national agreement with the AoC is limited in its scope and breadth for dealing with the level of organisational change that is being experienced by the sector so it is recommended that branches seek agreements along the lines of the model organisational change agreement where possible.
